Terms of Service

1. The service

Calmping provides automated monitoring, incident management, alerts, status pages, operational knowledge, and optional integrations for applications and services configured by you. Monitoring is an aid and does not replace your own operational, security, or backup controls.

2. Your account

You must provide accurate information, protect your password, enable appropriate security controls, and notify us if you suspect unauthorized access. You are responsible for actions taken through your account and API tokens.

3. Authorization to monitor

You may monitor only systems you own or are expressly authorized to test. You authorize Calmping to send the configured HTTP, DNS, TLS, TCP, and heartbeat requests to those targets.

4. Acceptable use

You must not use Calmping to scan, attack, overwhelm, disrupt, bypass access controls, collect data unlawfully, distribute malware, or monitor third parties without authorization. We may limit, suspend, or terminate abusive accounts to protect the service and others.

5. Plans, billing, cancellation

Available plans, limits, prices, and billing periods are shown before purchase. Paid subscriptions are processed by Stripe and renew until cancelled. You may manage or cancel through the Stripe customer portal. On downgrade/cancellation, apps above the plan limit may be paused but are not automatically deleted. Where you subscribe as a consumer, you have a statutory 14-day right of withdrawal. Because Calmping is a digital service supplied immediately, by subscribing and asking us to start the service at once you acknowledge that your right of withdrawal is lost once the service has been fully performed, in accordance with Article L221-28 of the French Consumer Code. Nothing here limits any mandatory refund, withdrawal, tax, or consumer-cancellation right that applies to you.

6. Your content and credentials

You retain rights to your monitoring configuration, results, runbooks, incidents, and postmortems. You grant us the limited right to process that content to provide and secure the service. You are responsible for keeping connected provider credentials current and granting only the permissions required. Where we process personal data on your behalf as your processor, our Data Processing Agreement applies and is incorporated into these terms.

7. Integrations and AI

Optional third-party integrations are provided at your direction and may be governed by separate provider terms, charges, quotas, and privacy policies. AI diagnoses may be incomplete or incorrect. You must review AI output before acting and remain responsible for operational decisions.

8. Availability and alerts

We aim to provide a reliable service, but do not guarantee uninterrupted monitoring or delivery of every alert. Failures may result from networks, providers, configuration, rate limits, maintenance, or events outside our control. Use more than one alert channel for critical services.

9. Security and backups

We apply the security measures described in the Privacy and Security pages. You remain responsible for your own application security, credentials, source data, and independent backups. A monitoring service is not a substitute for disaster recovery.

10. Data export and deletion

You may export your account data from Settings. Account deletion permanently removes account-owned data and cannot be undone. Some billing or legal records may be retained where required by law; confirm the exact retained records in the final reviewed policy.

11. Intellectual property

Calmping, its software, interface, branding, and documentation remain the property of Linoa Technologie or its licensors. These terms do not grant a right to copy, resell, reverse engineer, or misuse the service except where applicable law permits.

12. Suspension and termination

You may stop using the service or delete your account at any time. We may suspend or terminate access for material breach, abuse, non-payment, security risk, or legal requirement. Where reasonable, we will provide notice and an opportunity to export data.

13. Warranty disclaimer

To the maximum extent permitted by law, the service is provided "as is" and "as available." We disclaim warranties that are not expressly required by applicable law.

14. Limitation of liability

To the maximum extent permitted by law, Calmping is not liable for indirect or consequential loss, loss of profit, revenue, data, or goodwill, or for damage caused by networks, providers, misconfiguration, missed or delayed alerts, or events outside our reasonable control. Our total aggregate liability arising out of or in connection with the service is limited to the total fees you paid for the service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that cannot lawfully be excluded — including mandatory consumer rights.

15. Governing law and disputes

These terms are governed by French law. Subject to the mandatory consumer-protection rules of your country of residence, the competent courts are those having jurisdiction over the registered seat of Linoa Technologie. Consumers may bring or defend proceedings before the courts of their own place of residence where the law so provides.

16. Consumer mediation

If you are a consumer, first submit your complaint through our contact page. If our response does not resolve it, you may use a free consumer mediation procedure with CM2C, 49 rue de Ponthieu, 75008 Paris, France; telephone: 01 89 47 00 14; email: litiges@cm2c.net; online referral: cm2c.net/declarer-un-litige.php. Using mediation is optional and does not affect your right to go to court.

17. Changes

We may update these terms. We will post the revised date and provide additional notice for material changes where required.
